• In 2005, USCIS first time implemented random selection:
  • 05/05/2005 - Interim Final Rule, Immediately Effective
  • 11/07/2007 - Withdrawn
• In 2008, DHS prohibits one beneficiary can be filled by same/related employer multiple times:
  • 03/24/2008 - Interim Final Rule, Immediately Effective
  • 09/27/2018 - Withdrawn
• In 2011, DHS first time proposed electronic registration:
  • 03/03/2011 - First proposal
• DHS final rule on the latest electronic registration in 2020:
  • 12/03/2018 - Re Proposed
  • 01/31/2019 - Final Rule
  • Final Rule on Registration Fee

Note: The first two were ‘Interim rule with request for comments’ and eventually withdrawn

USCIS said in Final Rule that:

USCIS has experience in conducting a random selection in administering the H-1B cap and will continue to use a random selection process when selecting registrations.
